Welcome to notsoda.co.za. These Terms and Conditions govern your use of our website and any products or services offered through it. In these Terms, Not Soda is referred to as we, us, or our. By accessing or using this website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website.
1. About us
This website is operated by Not Soda, based in Cape Town, South Africa. All references to we, us, or our refer to Not Soda.
2. Use of the website
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use of this website by any third party. You may not:
- Use the website in any way that is unlawful or fraudulent
- Attempt to gain unauthorised access to the website or its systems
- Introduce viruses, malware, or any harmful technology
We reserve the right to suspend or terminate access if these Terms are breached.
3. Products and services
All products and services displayed on this website are subject to availability. We reserve the right to:
- Modify or discontinue any product or service without notice
- Limit quantities purchased per order
- Refuse service at our discretion
Product descriptions and images are provided for illustrative purposes and may vary slightly from the final product.
4. Pricing and payment
All prices are displayed in South African Rand (ZAR) unless stated otherwise, and may include or exclude VAT as indicated. We accept the following payment methods: credit/debit card, EFT, and QR. We reserve the right to:
- Change prices at any time without prior notice
- Correct pricing errors
Full payment must be received and confirmed before any order is processed or dispatched. No goods will be shipped until payment has cleared.
5. Orders and acceptance
An order is considered accepted only once payment has been successfully processed and a confirmation email has been issued. Placing an order does not constitute a binding agreement until this confirmation is sent. We reserve the right to cancel any order for reasons including but not limited to:
- Product unavailability
- Pricing or description errors
- Suspected fraudulent activity
If an order is cancelled by us, a full refund will be issued within 7-10 business days.
6. Delivery
Standard delivery is estimated at 3-5 business days from the date of dispatch. Delivery times are estimates and are not guaranteed. Delays may occur due to courier capacity, public holidays, or other circumstances beyond our control. Risk of loss or damage passes to the customer upon delivery and acceptance of the order.
Once an order has been dispatched and a tracking number has been issued, Not Soda is not liable for lost, stolen, or delayed parcels caused by the courier. Customers must lodge courier claims directly with the courier provider. If a delivery fails due to an incorrect address provided by the customer, or a parcel is uncollected and returned to us, re-delivery costs will be for the customer's account.
7. Returns and refunds
Returns and refunds are handled in accordance with the Consumer Protection Act (CPA) of South Africa. To qualify for a return, the item must be unused and in its original condition, and proof of purchase must be provided. Certain items may be non-returnable for hygiene or safety reasons. Refunds will be processed within a reasonable timeframe once approved. Full details are set out in our Return and Refund Policy below.
8. Intellectual property
All content on this website - including text, images, logos, branding, and layout and design - is the intellectual property of Not Soda or its licensors and may not be copied, reproduced, or used without written permission.
9. Limitation of liability
To the fullest extent permitted by law: we are not liable for any indirect, incidental, or consequential damages arising from your use of this website or our products; we do not guarantee uninterrupted or error-free access to the website; and we are not responsible for losses caused by courier delays, incorrect delivery addresses, or uncollected parcels. Your use of this website is at your own risk.
10. Drinks canning machines
Not Soda supplies drinks canning machines that may be installed on customer premises or in public spaces. By using or permitting the use of any Not Soda drinks canning machine, you acknowledge and agree that:
- Not Soda shall not be liable for any injury, illness, loss, damage, or death arising from the use or misuse of any machine, whether on customer premises or in a public space.
- Where a machine is installed on customer or third-party premises, the operator or premises owner is solely responsible for ensuring the machine is used safely, maintained in accordance with any instructions provided by Not Soda, and accessible only to appropriate users.
- Not Soda is not liable for any injury, damage, or loss caused by tampering, improper use, unauthorised modification, failure to follow operating instructions, or use of the machine by unsupervised individuals.
- Not Soda does not warrant that machines will be free from faults at all times. Any defects must be reported to us promptly. We accept no liability for incidents arising from continued use of a machine that has been identified as faulty.
- To the fullest extent permitted by South African law, Not Soda's total liability in connection with any machine-related claim shall not exceed the original purchase or rental price paid for that machine.
11. Machine warranty
Our machine warranty:
- 1-year warranty from date of purchase or delivery
- Covers defects in materials and workmanship under normal use
- Repair or replacement at Not Soda's discretion, at no charge
- Exclusions: misuse, neglect, unauthorised modification, failure to follow instructions, normal wear and tear, non-approved parts, and power surges or acts of God
- How to claim: email info@notsoda.co.za with proof of purchase and a description of the fault
- Your statutory rights under South African law are preserved
12. Indemnity
You agree to indemnify and hold Not Soda harmless from any claims, damages, losses, or expenses arising from your use of this website or breach of these Terms.
13. Privacy
Your use of this website is also governed by our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA).
14. Governing law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of South African courts.
15. Changes to these terms
We reserve the right to update or modify these Terms at any time. Changes will take effect once published on this website. Your continued use of the website constitutes acceptance of the updated Terms.

Return and Refund Policy
At Not Soda, customer satisfaction is important to us. This Return and Refund Policy outlines your rights and our obligations in accordance with the Consumer Protection Act, 68 of 2008 (CPA). By purchasing from notsoda.co.za, you agree to the terms set out below.
1. Cooling-off period (online purchases)
In terms of the CPA, customers are entitled to a 7-day cooling-off period for online purchases. You may cancel your order within 7 days of delivery, provided that the product is unused, unopened, and in its original packaging, and in a resalable condition. Return shipping costs will be for the customer's account unless the product is defective or incorrect.
2. Damaged, defective or incorrect items
If you receive a product that is damaged, defective, or incorrect, please notify us within 48 hours of delivery, providing clear photographs and your order number. In such cases, you are entitled to a replacement, a full refund, or repair (where applicable). We will cover all reasonable return shipping costs for approved claims.
3. Non-returnable items
For hygiene and safety reasons, the following items may not be eligible for return unless faulty: opened food or beverage products, products that have been partially consumed, and items not in original packaging. This does not limit your rights under the CPA.
4. Refunds
Once a return has been received and inspected, approved refunds will be processed within 7-10 business days and issued to the original payment method used at checkout. Bank processing times may vary.
5. Exchanges
If you wish to exchange a product (subject to availability), contact us within 7 days of delivery. The product must meet return eligibility requirements. Any price difference will be settled before dispatch of the replacement item.
6. Order cancellations
Before dispatch, orders may be cancelled for a full refund. After dispatch, an order will be treated as a return and subject to the cooling-off conditions above.
7. Sale items
Sale or promotional items are non-refundable unless defective or supplied incorrectly, as required by law.
